ИНСТИТУЦИОНАЛЬНО-ПРАВОВЫЕ ОСНОВЫ ЭФФЕКТИВНОГО ФУНКЦИОНИРОВАНИЯ СИСТЕМЫ УДОВЛЕТВОРЕНИЯ ПОТРЕБНОСТЕЙ ОБЩЕСТВЕННОГО СЕКТОРА

Аннотация

В статье обосновываются публичные закупки как важнейшая функция государства по удовлетворению потребностей субъектов общественного сектора, обеспечивающая непрерывность производства общественных благ. Показано, что кроме этой функции закупки способствуют реализации и других целей государства, например, с 2014 г. в России они целеориентированы на импортозамещение, реализацию новой промышленной политики, а в настоящее время выполнение 13 новых национальных проектов. Проведен сравнительный анализ теоретических оснований публичного прокьюремента и ряда эмпирических исследований разных авторов и организаций, доказывающих существование конфликта между установленными институционально-правовыми основаниями госзакупок и адекватным их соблюдением заказчиками и участниками торгов. Это позволило сделать вывод о необходимости систематического повышения квалификации специалистов по госзакупками как вследствие непрерывных изменений законодательства, так и недостаточной квалификации (знаний) закупщиков.

Abstract

The article substantiates public procurement as the most important function of the state to meet the needs of public sector entities, ensuring the continuity of production of public goods. It is shown that in addition to this function, procurement contributes to the implementation of other goals of the state, for example, since 2014 in Russia they are focused on import substitution, the implementation of a new industrial policy, and currently 13 new national projects are being implement-ed. A comparative analysis of the theoretical foundations of public procurement and a number of empirical studies of vari-ous authors and organizations proving the existence of a conflict between the established institutional and legal founda-tions of public procurement and their adequate observance by customers and bidders is carried out. This allowed us to conclude that there is a need for systematic professional development of public procurement specialists, both as a result of continuous changes in legislation and inadequate qualifications (knowledge) of purchasers.
